The Administrator of this The Arboretum x Windy City Bulls sweepstakes (the “Sweepstakes”) is Chicago Professional Sports Limited Partnership, owner of the Chicago Bulls professional basketball team (“Bulls”), with an address of 1901 W. Madison Street, Chicago, IL 60612 and the Sponsor of this Sweepstakes is The Arboretum, with an address of 100 W. Higgins Road, Suite H-72, South Barrington, IL 60010. All entrants agree to be bound by the terms and conditions provided in these Official Rules as well as by all interpretations of these Official Rules by the Windy City Bulls and by all other decisions of the Windy City Bulls, including resolution of disputes in connection with this sweepstakes, which are final and binding in all matters relating to the Sweepstakes.

ELIGIBILITY

The Sweepstakes is open to legal residents of Illinois who are at least 18 years or older at the time of entry. Employees and immediate families of employees (spouse, parents, siblings, and children) of The Arboretum, Windy City Bulls, the National Basketball Association and its Member Teams, NBA Properties, Inc. and each of their respective parents, subsidiaries, affiliates and related entities, as well as each of the aforementioned parties’ respective directors, officers, owners, members, employees and agents are not able to enter or win.

ENTRY PERIOD

The Sweepstakes begins on Saturday, November 16, 2024 at 12:00AM Chicago timeand ends on March 31, 2025 at 11:59PM Chicago time (the “Entry Period”).

HOW TO ENTER

Via the Internet: During the Entry Period entrants can go to https://forms.office.com/r/1hLHnibdJW and follow the entry instructions to complete the online entry form. All entrants must accurately complete all required fields or entry will be deemed invalid. In order to participate you will need Internet access and a valid email address. Limit one entry per person, per month. Multiple monthly entries per person, including multiple entries by the same entrant using different e-mail addresses, will invalidate ALL entries submitted by that entrant for the entire Entry Period. All entries must be received by the Windy City Bulls by the last day of each month during the Entry Period at 11:59PM Chicago time.

As part of the online entry submission process you may be asked if you wish to receive promotional emails from the Windy City Bulls. Consenting to receive promotional emails from the Windy City Bulls is optional and is not required for participation in the Sweepstakes.

WINNER SELECTION

One winner (five total during the Entry Period) will be selected randomly on or about the first day of each month during the Entry Period from among all eligible entries received. Winners will be contacted by a member of the Windy City Bulls business staff by email or phone number provided in the sweepstakes entry form on or about the fifth day of each month during the Entry Period. In the event the winners cannot be contacted within 72 hours of the initial email or phone notification or declines the prize another winner will be randomly selected from the eligible entries received.

It is the sole responsibility of the entrant to notify the Bulls if his or her contact information and/or e-mail address changes. To do so, send an e-mail to athomas@bulls.com with the new contact information. The Windy City Bulls and/or the National Basketball Association and its Member Teams, NBA Properties, Inc., The Arboretum and each of their respective parents, subsidiaries, affiliates, directors, officers, owners, shareholders, members, employees sponsors, licensees, successors, assigns and agents are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic; including without limitation the incorrect or inaccurate capture of entry information online, or for lost, late, incomplete, damaged, destroyed, delayed, stolen, misdirected or illegible entries. Entry materials/data that have been tampered with or altered are void. Once submitted, entries become the sole property of Windy City Bulls and will not be returned.

Winners may be required to sign an Affidavit of Eligibility and Release attesting to the fact that he/she is 18 years of age or older, as well as other terms and conditions as designated by the Windy City Bulls and consent to the use of his/her likeness in order to collect a prize.

PRIZE DESCRIPTION

There will be five Winners (defined below). The Winners will each receive four Windy City Bulls courtside tickets to a mutually agreeable team home game during the Entry Period and a $100 gift card to a restaurant located at The Arboretum. Total approximate retail value of each prize package is $500.

The winning prize is non-transferable to any other person, including relatives or friends. The name of the winner(s) can be obtained by writing “The Arboretum x Chicago Bulls” c/o Chicago Bulls 1901 W. Madison Street, Chicago, IL 60612.

Prize winner and guest must agree to comply with all NBA venue rules and regulations relating to the use of NBA regular and post-season tickets (as applicable) and, in accordance therewith, agree not to act in an unsportsmanlike or disruptive manner, or with any intent to annoy, abuse, threaten or harass any other person at such game. Failure to do so may result in forfeiture of prize or prize element.

TAXES

The prize winner is solely responsible for all applicable federal, state and local taxes and any expenses associated with the sweepstakes, unless otherwise indicated. No substitution, cash equivalent or transfer of prize permitted except at the Bulls option for a prize of comparable or greater value.

NO PURCHASE NECESSARY; ODDS OF WINNING

No purchase necessary to enter or win a prize. A purchase will not improve your chances of winning. The odds of winning will depend on the number of eligible entries received.

RELEASE OF LIABILITY AND INDEMNIFICATION

By entering, each entrant agrees to follow the Sweepstakes Official Rules and forever releases, discharges, and waives any and all claims, liabilities and actions of any kind, howsoever caused or arising and whether by negligence, any intentional act or otherwise, that entrant may have or that may arise against Facebook, Instagram, The Arboretum, the Bulls, Chicago Bulls Limited Partnership, BSV Limited Partnership, At Your Service LLC, At Your Service Management Corp., CBLS Corp., United Center Joint Venture, Northwest Sports, LLC and/or the National Basketball Association and its Member Teams, NBA Properties, Inc. and each of their respective parents, subsidiaries, affiliates, related entities, licensees, distributors, dealers, retailers, and sponsors, as well as each of the aforementioned parties’ respective directors, officers, owners, shareholders, members, employees, representatives, successors, assigns and agents (collectively, the “Released Parties”), with respect to or arising out of either (i) entrant’s participation; or (ii) the receipt or use of the prizes (including but not limited to the substitution or changing of any prizing) awarded in the Sweepstakes, including but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries, including but not limited to data entry errors resulting from or caused by the entering, keying, or mis-keying of the required information by entrants; (f) injury or damage to persons or property, including loss of data, that may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use of any prize; (g) the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of any Prize or any travel or activity related to the receipt or use of any Prize; or (h) the impact of any epidemic, pandemic, governmental directive or other cause outside the reasonable control of a Released Party. By entering, each entrant further agrees to defend, indemnify and hold harmless the Released Parties and their insurers against any and all damages, costs, judgments, and/or expenses (including but not limited to attorneys’ fees and/or other legal fees) they may incur as a result of claims made against them in connection with either (i) entrant’s participation; or (ii) the receipt or use of the prizes (including but not limited to the substitution or changing of any prizing) awarded in the sweepstakes. Each entrant further acknowledges that none of the Released Parties or anyone else has either made, or is in any manner responsible or liable for, any warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to any prize, including but not limited to, its quality or availability, and all such warranties are disclaimed in their entirety. PRIZES ARE AWARDED “AS IS” WITH NO WARRANTY OR GUARANTEE EXPRESS OR IMPLIED. THE BULLS DISCLAIM ALL AND ANY LIABILITY FOR THE ACTUAL QUALITY OR NATURE OF ANY PRODUCT OR SERVICE ACCEPTED BY THE WINNER.

GENERAL CONDITIONS

Neither the Released Parties nor any of their service providers are responsible for (i) stolen, late, incomplete, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, or garbled entries, transmissions, email or mail; (ii) telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures or difficulties of any kind; (iii) failed, incomplete, garbled or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Bulls that may cause the Sweepstakes to be disrupted or corrupted; (v) any injuries, losses or damages of any kind arising in connection with or as a result of the Sweepstakes, acceptance, possession, or from participation in the Sweepstakes; (vi) any printing or typographical error in any material associated with the Sweepstakes; (vii) any other errors, problems or difficulties of any kind whether human, mechanical, electronic, network, computer, telephone, wireless service, mail, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties that may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of a prize or in any Sweepstakes-related materials; or (viii) any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes.

CAUTION: ANY ATTEMPT TO DAMAGE ANY WEBSITE OR MOBILE APPLICATION ASSOCIATED WITH THE SWEEPSTAKES, TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE BULLS WILL DISQUALIFY ANY ENTRANT RESPONSIBLE FOR THE ATTEMPT, AND THE BULLS AND THE APPLICABLE RELEASED PARTIES AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY ENTRANT OR INDIVIDUAL(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Except where prohibited by law, in consideration for being permitted to participate in this Sweepstakes and the opportunity to win the prizes offered in this Sweepstakes, each entrant hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of the entrant’s name, likeness, voice, photograph, performance, personal statements and/or biographical information in any and all advertising, promotions and other publicity conducted by The Arboretum, Windy City Bulls and/or the National Basketball Association and its Member Teams, NBA Properties, Inc. and each of their respective parents, subsidiaries, affiliates, agents, licensees, successors and assigns.

DISPUTE RESOLUTION

BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED FIFTY DOLLARS ($50.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED FIFTY DOLLARS ($50.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; (D) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF; AND (E) ENTRANT IRREVOCABLY AGREES TO BRING ANY ACTION ARISING OUT OF OR RELATED TO THE SWEEPSTAKES IN THE CIRCUIT COURT OF COOK COUNTY, ILLINOIS, OR THE UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF ILLINOIS (IF JURISDICTIONAL PREREQUISITES ARE SATISFIED).

SWEEPSTAKES CANCELLATION, SUSPENSION OR MODIFICATION

The Windy City Bulls reserve the right to cancel, modify or suspend the sweepstakes and/or change dates or prizes (to a prize of equal or greater value) relating to the promotion in case of schedule changes, acts of God, force majeure events, computer viruses, bugs, corruption or unfairness of the security or administration of the sweepstakes, or for any other reason at the sole discretion of the Bulls. Any entrant that enters the Sweepstakes via a fake account (e.g., bot account) will be disqualified. If the Bulls cannot determine the identity of the person based upon the information submitted via the entry form, the respective entrant will be disqualified. No mechanically or programmatically reproduced entries are permitted.
